Mutual LLC (“Mutual,” “we,” “us”) respects the privacy of its users (“you”) and is committed to protecting your privacy. This Privacy Policy describes the information we process about you, how we may use that information, who we may share it with, and your choices about such uses and disclosures. We encourage you to read this Privacy Policy carefully prior to using our mobile software application known as “mutual” (the “App”) or our website located at http://www.mutual.app/ (the “Website”) (the App, Website, and services made available through each are collectively, the “Service”). By using the Service, you are accepting the practices described in this Privacy Policy.

IF YOU DO NOT AGREE TO OUR PRIVACY PRACTICES DESCRIBED IN THIS PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE SERVICE. YOUR USE OF ANY PART OF THE SERVICE CONSTITUTES YOUR AGREEMENT TO OUR PRIVACY PRACTICES.

1. INFORMATION WE PROCESS ABOUT YOU

1.1. In General

Through the Service, we may process information that can identify you personally such as your name and email address (“personal information”). By using the Service, you are authorizing us to process your personal information in connection with providing the Service. When you provide personal information through the Service, the personal information may be processed in servers located in the United States. “Personal information” does not apply to information which does not relate to an identified or identifiable individual or to personal information or data rendered anonymous in such a manner that the individual is not or no longer identifiable (“Anonymized Information”). Anonymized Information may be derived from personal information. We hold all rights in and may use Anonymized Information for our own purposes in any manner and without attribution or compensation to any person.

1.2. Personal Information You Provide to Us

To use the App, you will be required to create a user profile (“Profile”). You will also be asked to allow Mutual to process your location information from your device when you use the App. Also, we may process any personal information you provide as part of creating your Profile or during your use of the Service. This may include personal information, such as your name, email address, telephone number, and, if you transact business with us, financial information. You may also provide us photos, information about you and your interests, and information about your preferences for matching with other Mutual users, such as search distance and age range. If you chat with other Mutual users, you provide us the content of your chats, and if you contact us through the App or Website, you provide us with the content of that communication.

1.3. Use of Technologies to Process Information

We use various technologies to process personal information from your device and about your use of the Service.

1.3.1. Information Processed Automatically

We automatically process personal information from your browser or device when you visit the Service. This information could include your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, your mobile device's geographic location when the App is opened or is actively running, and the referring website address.

1.3.2. Cookies and Use of Cookie Data

When you use the Service, we may assign your device one or more cookies to facilitate access to the Service and to personalize your experience. Through the use of a cookie, we also may automatically process information about your activity on the Service, such as the pages you visit, the time and date of your visits, and the links you click. If we advertise, we (or third party advertisers) may use certain data processed on the Service to show you Mutual advertisements on other sites or applications.

1.3.3. Pixel Tags

We may embed pixel tags (also called web beacons or clear GIFs) on web pages, ads, and emails. These tiny, invisible graphics are used to access cookies and track user activities (such as how many times a page is viewed). We use pixel tags to measure the popularity of various aspects of the Service. Ad companies also use pixel tags to measure the number of ads displayed and their performance (such as how many people clicked on an ad).

1.3.4. Mobile Device IDs

If you're using the App, we use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or advertising IDs (for iOS 6 and later), instead of cookies, to recognize you. We do this to process your preferences and track your use of the App. Unlike cookies, device IDs cannot be deleted, but advertising IDs can be reset in “Settings” on your iPhone. Ad companies also use device IDs or advertising IDs to track your use of the App, track the number of ads displayed, measure ad performance and display ads that are more relevant to you. Analytics companies use device IDs to track information about app usage.

1.3.5. Do Not Track Options

Your web browser(s) may offer a “Do Not Track” option, which allows the individual to signal to operators of websites and web applications and services (including behavioral advertising services) that he or she does not wish such operators to track certain of his or her online activities over time and across different websites. We do our best to support Do Not Track requests but cannot guarantee full support based on the variety of internet browsers and technologies which means that we may process information about your online activity both while you are using the Service and after your use of the Service.

1.4. Information Processed by Third Parties

We may allow service providers, advertising companies and ad networks, and other third parties to display advertisements through the Service. These companies may use tracking technologies, such as cookies or web beacons, to process information about users who view or interact with their advertisements. Except as described in this Privacy Policy, including disclosures to our subprocessors and the advertising-related sharing described in Section 5, we do not provide your personal information to third parties. We may provide Anonymized Information to third parties. We also work with third-party service providers (“subprocessors”) who process information on our behalf to operate, secure, and improve the Service. These include providers of messaging infrastructure, push notifications, email delivery, error and crash reporting, customer support, payment and subscription processing, attribution and analytics, in-app engagement, and automated content moderation. We require subprocessors by contract to protect your information and to process it only for the purposes for which we engaged them.

1.5. Automated Content Moderation

We use automated tools and third-party services to review photos uploaded to the Service to enforce our community guidelines and keep the Service safe. This review may include detection of policy-violating content (such as nudity) and, when you submit a verification photo, a check against our database of users we have previously removed from the Service. Our face-matching system processes information derived from the geometry of faces in verification photos and stores this information only for users we have removed from the Service. For users subject to specific statutory retention limits (including residents of Illinois under the Biometric Information Privacy Act), we destroy stored face-geometry information within three years of the user's last interaction with the Service. Face-geometry information is used only for the safety and integrity of the Service; it is never used for advertising, sold, or rented to third parties.

2. HOW WE USE THE INFORMATION WE PROCESS

2.1. In General

We may use information that we process about you to do any of the following:

  • verify your eligibility to use the Service;
  • provide and improve the Service, and operate our business;
  • manage your account and provide customer support;
  • perform research and analysis about your use of, or potential interest in, our or third parties' content, products and services;
  • communicate with you by email or through the App about our or third parties' content, products or services that may be of interest to you;
  • analyze, display, and track content and advertising tailored to your interests through the Service and other sites, including providing our advertisements to you when you visit other sites;
  • perform website and mobile application analytics;
  • enforce or exercise any rights under our Terms of Service; and
  • perform functions or services as otherwise described to you at the time we process information from you.

In all cases, we may perform these functions directly or using a third-party vendor. If we use any third-party vendor, our agreement(s) with the vendor will limit their right to use information processed about you to performing functions solely on Mutual's behalf. Also, if you access the Service from a third-party social platform, such as Facebook, we may share Anonymized Information with that platform to the extent permitted by your agreement with that third party and its privacy settings.

2.2. Lawful Basis for Processing

Many jurisdictions require that we disclose to you the lawful basis for our processing of your personal information. We do that throughout this Privacy Policy. In general, our lawful basis for processing your personal information is based on your specific consent or your contract with us.

By accessing or using any of the Service, you consent to our processing of your personal information as described in this Privacy Policy. If our processing of your personal information is based on your consent, you may withdraw your consent at any time, and we will cease processing your personal information. However, in some cases, this may result in your inability to receive partial or full access to the Service, and your withdrawal of consent does not limit our ability to use the Anonymized Information for use by us in connection with our legitimate business efforts in the future. In addition, your withdrawal of consent may not prevent us from processing personal information if we have processed such personal information pursuant to a different lawful basis or to preserve legal claims. For example, if you give your consent for us to process your personal information, but we are also required by law to keep your personal information, that separate “lawful basis” will still apply, even if you withdraw your consent.

When you enter into an agreement with us, either by accessing the Services, by executing an agreement in hard copy, or by clicking “I Accept” or similar language online or through a mobile application, we will process your personal information for the purposes of fulfilling the terms of our contract with you. In that case, our processing of your personal information is based on the contract, so your withdrawal of consent will only be effective after the purposes for processing that personal information have been fulfilled and after we no longer have a legal obligation to keep that personal information.

In all cases, we will comply with applicable law and we will cease processing your personal information after the legal right, obligation, or other lawful basis expires.

3. WHO WE SHARE INFORMATION WITH

3.1. Information Shared with Other Users

When you complete your Profile and begin using the App, your Profile will be viewable by other users of the App. You can see your Profile by going to “Account” and “My Profile” in the App. If you swipe up to indicate that you are interested in another user, you will be able to chat with that user if they also swipe up to indicate that the interest is mutual. If you chat with users with whom you have matched, the content of those chats is visible to you and to the other participants in the chat.

3.2. Personal Information

We do not share your personal information with others except as described in this Privacy Policy or when we inform you and give you an opportunity to opt out of having your personal information shared.

3.2.1. Service Providers

We may share personal information, including personal and financial information, with third parties that perform certain services on our behalf. These services may include but are not necessarily limited to development, support, and maintenance of the Service; tracking and analytics; troubleshooting; providing customer service; performing business and marketing functions and analysis; ad tracking and analytics; conducting user inquiries or investigations pursuant to our Terms of Service; and providing contests, sweepstakes, surveys and other features offered through the Service. These service providers may have access to personal information needed to perform their functions but our agreements with them do not permit them to share or use such information for any other purposes.

3.2.2. Other Circumstances

We may disclose your personal information in the following circumstances:

  • In response to a court order or a request for cooperation from law enforcement or another government agency; to exercise or establish our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.
  • When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action to prevent or stop illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property, and safety of our business and our users, shareholders, employees, service providers and others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms of Service and any other agreements, guidelines or policies applicable to our users.
  • In connection with a corporate transaction, such as the sale of all or part of our business, a divestiture, merger, consolidation, or in the unlikely event of bankruptcy.

3.3. Anonymized Information

We may use and share Anonymized Information we process under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising through the Service and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine Anonymized Information we process with additional Anonymized Information processed from other sources. We also may share Anonymized Information with third parties, including advertisers and investors, for the purpose of conducting business analysis or other business purposes. For example, we may engage a data provider who may convert web log data from you (including IP address and information about your browser or operating system) into Anonymized Information, or place or recognize a unique cookie on your browser to enable you to receive customized ads or content. The cookies may reflect demographic or other data linked to data that you voluntarily submitted to us (such as your email address), which we may share with a data provider solely as Anonymized Information.

4. THIRD PARTY SERVICES

There may be occasions where you are able to click on a link to access other websites, products or services (collectively, “third party services”) that do not operate under this Privacy Policy. For example, if you click on an advertisement that appears in the App, you may be taken to a third-party service that we do not control. These third-party services may independently solicit and process information, including personal information, from you and, in some instances, provide us with information about your interaction with those third-party services. We recommend that you review the privacy policies of all third-party services that you visit; typically, privacy policies can be found at the bottom of webpages.

5. HOW YOU CAN ACCESS YOUR INFORMATION

If you have a Mutual account, you can review and edit most personal information included in your Profile by going to “Account” and then “My Profile” in the App. You also may delete your account at any time by going to “Account” and then “Delete My Account” in the App. When you delete your account, your Profile is removed from the Service and is no longer visible to other users. We may retain certain information after account deletion, including account identifiers, photos, chat content, user reports, and transaction records, to prevent fraud and impersonation, to detect and block users previously banned or suspended for violations of our Terms of Service, to investigate reports of abuse, to enforce our Terms of Service, to comply with our legal and tax obligations, and to defend against legal claims. Information retained after account deletion may also be used to contact you about the Service, for example, to invite you back, request feedback or a success story, or announce new features. We may share Anonymized Information with third parties in our sole discretion. We may also share Personal Information in hashed form with advertising platforms so that we can reach you with advertisements on other sites and apps. 6. YOUR CHOICES ABOUT PROCESSING AND USE OF YOUR INFORMATION

6.1. Limiting the Information You Provide

You can choose not to provide us with certain information, but that may result in your not being able to use certain features of the Service.

6.2. Notifications

The Service may from time to time deliver notifications to your mobile device. You can disable these notifications by going to “Settings” and then “Notifications” in the App or by changing the notification settings on your mobile device.

6.3. Cookies

You can delete or decline cookies by changing your browser settings. Click “help” in the toolbar of most browsers for instructions.

7. PROTECTING YOUR PERSONAL INFORMATION

7.1. Mutual Security Measures

We take technical and organizational security measures to help safeguard your personal information from unauthorized access and disclosure. However, no system can be completely secure. Therefore, we cannot promise, and you should not expect, that your personal information, chats, or other communications will always remain completely secure.

7.2. What Else You Can Do to Protect Your Information

When you disclose personal information as part of your Profile or in chats with other Mutual users, that information will be viewable by other Mutual users (or in the case of chats, by the user with whom you are chatting). We encourage you to use discretion and caution when choosing what personal information to disclose.

8. CHILDREN'S PRIVACY

We restrict use of the App to individuals who are at least 18 years old and do not knowingly process personal information from children under the age of 18. If we become aware that we have processed personal information from a person under 18, then we will attempt to delete such personal information as soon as possible, subject to our obligations under applicable law. 9. VISITING THE SERVICE FROM OUTSIDE THE UNITED STATES

The Service is hosted by servers located in the United States. If you attempt to use the Service from a physical location within the European Union, the European Economic Area, United Kingdom, Asia, or any other region with laws or regulations governing personal data processing that differ from United States laws, please be advised that: (a) you are transferring your personal information to the United States; and (b) you consent to such transfer.

10. YOUR RIGHTS REGARDING YOUR DATA

Under applicable data protection, privacy, and other laws, you may have certain rights related to your access and control of your personal information. Such rights may include the following:

  • The right to access, correct, update, or request deletion of your personal information.
  • The right to object to processing or restrict the processing of your personal information (Please note that if you exercise this right, it may limit or eliminate our ability to provide you the Service).
  • The right to request portability of your personal information.
  • The right to opt-out of marketing communications we send you. You can exercise this right by clicking the “Unsubscribe” or “Opt-Out” link found in these communications.
  • The right to not be subject to a decision based solely on automated processing, including profiling, known as Automatic Decision Making.
  • The right to submit a complaint to any applicable regulatory authority about our processing activities.
  • The right to opt-out of us sharing (as defined in the CPRA) your personal information, including for direct marketing purposes, subject to certain legal exceptions.
  • The right to limit use, disclosure, and restrict sensitive personal information (as defined in the CPRA).

We may use additional processes to verify your identity before we reveal or delete any of your personal information, including two-factor or two-step authentication measures to ensure we can identify you.

Further, although we currently do not process personal information without consent, if we at any time in the future process personal information without your express consent, you may opt-out or withdraw consent at any time.

Please note that exercising any of the above rights may limit or eliminate our ability to provide you the Service. If so, we may terminate the Service due to such requests.

We will try to comply with your request(s) as soon as reasonably practicable and at the very least as required under applicable law. Upon receipt of your written request, we will provide you with a copy of your information, although in certain limited circumstances we may not be able to make all relevant information available to you, such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request.

Please also note that if you do opt-out of receiving marketing-related emails from us, we may still send you messages for administrative or other purposes directly relating to your use of the Service, and you cannot opt-out from receiving those messages while continuing to use the Service.

Further, you may opt-out or disable certain functions on your particular device, preventing us from processing personal information. For example, you may disable geolocation or GPS functionality on your mobile device or disable push notifications. If you disable such features, your ability to use and access the Service may be limited.

10.1. Privacy for EU/UK Residents

The Regulation (EU) 2016/679 (General Data Protection Regulation) made effective in Europe on May 25, 2018 (“GDPR”) requires that we clearly describe to Data Subjects (as defined in the GDPR) the data we process and how we use that data. This Privacy Policy does that and if you have any questions for us regarding our data processing, please contact us at [email protected]. We comply with the GDPR requirements to the extent they apply to us.

We are based in the United States. By accessing or using the Service or otherwise providing information to us, you understand that your information will be subject to processing in and to the United States and in our other locations.

Pursuant to the GDPR, residents of the EU (and the EEA, as applicable) have the right to obtain our confirmation of whether we maintain personal information relating to them in the United States. We process the following special categories of Personal Information (Article 9 of the GDPR) only with your explicit consent, provided when you enter the information or submit a verification photo:

  • Data concerning your religious beliefs (for example, the denomination or religious community you identify with) that you provide as part of your Profile;
  • Biometric data used to identify you, specifically the face-geometry information described in Section 1.5, which is processed only when you submit a verification photo and is retained only for users we have removed from the Service.

Further, if you are a resident of the United Kingdom (“UK”), to the extent the GDPR as incorporated into UK law pursuant to s.3 of the European Union (Withdrawal Act) 2018 (as amended, the “UK GDPR”) applies to us, we will follow all supplemental requirements under the UK GDPR and you have all rights as a UK citizen under the UK GDPR.

10.2. Privacy for California Residents

California adopted the California Consumer Privacy Act (“CCPA”), which took effect at the beginning of 2020 and has now adopted the California Privacy Rights Act (“CPRA”), which fully took effect January 1, 2023. We comply with the requirements of the CCPA and CPRA to the extent they apply to us.

If you are a California resident, you may request to exercise your rights for any personal information we have processed in the 12 months prior to your request. Such request covers any categories, sources, purposes, and, if applicable, third parties to whom we share the personal information. Further, you can exercise any of your rights free of discrimination, for example, we cannot increase the price of the Service or decrease the quality of the Service because you exercise your rights.

11. CHANGES TO PRIVACY POLICY

We reserve the right to update this Privacy Policy from time to time in our discretion. When we make such changes, we will post the updated version of this Privacy Policy on the Website and within the App. We will also update the “Last Updated on” notice at the beginning of this Privacy Policy to indicate when we last made changes. Any changes to this Privacy Policy will take effect immediately after posting notice of such changes within the App or on the Website. If you do not agree to any changes after receiving notice of such changes, you must stop using the Service. Otherwise, your continued use of the Service constitutes your acceptance of such changes. WE ENCOURAGE YOU TO CHECK WITHIN THE APP OR ON THE WEBSITE REGULARLY TO MAKE SURE THAT YOU ARE FAMILIAR WITH THIS PRIVACY POLICY AND ANY UPDATES WE MAKE TO THEM.
